Terms of Service

1. Who we are

The Service is operated by Appbiz Studio, LLC. You can reach us at any time at hey@abdoul.dev.

2. What the Service is

The Service has two parts, and some of these Terms apply to only one of them:

• The Montaj app— a video editor that runs on your device. Editing, transcription, subtitles and audio processing happen locally, on your own hardware.
• The Montaj website— editorial pages plus a set of free browser-based video tools. Some of those tools run entirely in your browser; others send the link you paste to our server so it can fetch the file for you.

Montaj is under active development. Features may be added, changed, or removed, and parts of the Service may be unavailable at times.

3. Who may use the Service

You must be at least 13 years old, or the minimum age of digital consent in your country if that age is higher. By using the Service you confirm that you meet that requirement and that you can enter into these Terms. If you use the Service on behalf of an organisation, you confirm you are authorised to bind it.

4. Your licence to use Montaj

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the Montaj app on devices you own or control, and to use the website tools, in accordance with these Terms. That is the only right you receive; we keep everything else.

5. Your content stays yours

You keep every right you already have in the videos, audio, images and text you edit with Montaj. We claim no ownership over them and we ask for no licence to use them — not to host them, not to improve our software, not to train any model.

This is not just a promise on paper: the app processes your media on your device, so your footage is never sent to us in the first place. What happens on the website is described in our Privacy Policy.

Because your projects live on your device, you are responsible for your own backups. Deleting the app, losing the device, or a failure of your device’s storage will take your projects with it, and we cannot recover them for you.

6. Content you are allowed to process

You are responsible for the material you put into the Service. You confirm that, for every file or link you use, you own the rights, have permission, or are otherwise allowed by law to use it in the way you intend.

This matters most for the website tools that fetch a video from a link. Downloading content from a third-party platform may be restricted by that platform’s own terms of service and by copyright law in your country. We provide a technical tool; deciding whether you may lawfully use it on a given video is your call and your responsibility. Do not use these tools to copy or redistribute content you have no right to.

7. Things you must not do

You agree not to:

• use the Service to create or distribute unlawful, infringing, hateful or abusive content, or sexual content involving minors;
• use the Service to impersonate a real person, or to produce deceptive synthetic media intended to mislead;
• reverse-engineer, decompile or disassemble the app, except to the extent the law expressly allows it;
• resell, sublicense, rent out or redistribute the Service;
• attack, overload, probe or otherwise interfere with the website or its servers, including by automated scraping or bulk requests to our endpoints;
• circumvent any rate limit, access restriction or security measure;
• use the Service in breach of applicable law, sanctions or export controls.

8. Price, purchases and refunds

Montaj is free to download and use today, with no watermark. If we later introduce paid features, the price and what it covers will be shown to you before you buy anything, and these Terms will be updated.

Any purchase made inside the app is a transaction with Apple, not with us: Apple takes the payment through your Apple Account and applies the Apple Media Services Terms and Conditions. We have no access to your payment method. Refund requests therefore go to Apple, at reportaproblem.apple.com.

9. Our intellectual property

The Service itself — the app, the website, the source code, the design, the Montaj name and logo, and the written content we publish — belongs to Appbiz Studio, LLC or its licensors, and is protected by intellectual property law. The licence in section 4 does not transfer any of it to you.

Montaj is built in part on third-party open-source components, each under its own licence. Nothing in these Terms limits the rights those licences give you in the components themselves.

10. Third-party services and content

The Service links to and relies on services we do not control, including Apple’s App Store and the platforms whose links you may paste into the website tools. Your use of those services is governed by their own terms and privacy policies. We are not responsible for them, for their availability, or for the content they host.

11. Feedback

If you send us ideas, bug reports or suggestions, you allow us to use them freely to improve the Service, with no obligation and no compensation. You do not have to send us anything.

12. Disclaimers

The Service is provided “as is” and “as available”, without warranty of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free from data loss, and we do not warrant that automatic transcription, subtitles or audio processing will be accurate. Always review the output before you publish it.

Some jurisdictions do not allow the exclusion of certain warranties. In those places, this section applies only to the extent permitted, and your statutory consumer rights are unaffected.

13. Limitation of liability

To the maximum extent permitted by law, Appbiz Studio, LLC will not be liable for indirect, incidental, special, consequential or punitive damages, nor for any loss of profits, revenue, goodwill, footage or data, arising out of or related to your use of the Service.

To the maximum extent permitted by law, our total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim, or USD 50.

Nothing here limits liability that cannot be limited by law, including liability for fraud or for death or personal injury caused by negligence.

14. Indemnity

You agree to cover us for claims, damages and reasonable costs brought by a third party because of content you processed with the Service, or because you used the Service in breach of these Terms or of the law.

15. Suspension and termination

You can stop using the Service at any time by deleting the app and leaving the site. We may suspend or end your access if you breach these Terms, or if we need to protect the Service or other users. We may also discontinue the Service, or any part of it, at any time.

Sections that by their nature should outlive this agreement — intellectual property, disclaimers, limitation of liability, indemnity and governing law — survive termination.

16. Apple App Store

When you get the Montaj app through the App Store, the following also applies:

• These Terms are between you and Appbiz Studio, LLC only, not with Apple. Apple is not responsible for the app or its content.
• Apple has no obligation to provide any maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price, if any. Beyond that, Apple has no warranty obligation for the app.
• Apple is not responsible for addressing any claim you or a third party may have about the app, including product liability claims, claims that the app fails to conform to a legal requirement, and claims under consumer protection or similar law.
• If a third party claims the app infringes their intellectual property, Appbiz Studio, LLC, not Apple, is responsible for the investigation, defence, settlement and discharge of that claim.
• You confirm you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

17. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. Disputes will be brought exclusively before the state or federal courts located in Delaware — except where consumer protection law in your country of residence gives you the right to bring proceedings there, in which case that right stands.

If any part of these Terms is found unenforceable, the rest stays in force. Our not enforcing a provision at some point is not a waiver of it.

18. Changes to these Terms

We may update these Terms. The “last updated” date at the top always reflects the current version. If a change is material, we will make it visible in the app or on the site. Continuing to use the Service after a change means you accept the new version.
